Широко известна документальная сцена с участием этого голливудского сценариста, когда тот спорит с председателем комитета HUAC Палаты представителей США Парнеллом Томасом осенью 1947 года. Томас задает вопрос, но Лоусон не отвечает, а продолжает объяснять, почему он согласно Биллю о правах не обязан отвечать на вопросы о своей принадлежности к каким-либо организациям. Председатель спрашивает Лоусона, является ли он членом Коммунистической партии, но сценарист не дает прямой ответ, продолжая рассказывать про Билль о правах. Томас стучит своим судебным молоточком, пристав пытается навести порядок, оба мужчины перебивают друг друга, и так по кругу много раз. Наверно, не меньше 10 раз задавался тот вопрос, и давался дерзкий энциклопедический ответ. Оливер Стоун включил эту сцену в свой документальный сериал «Нерассказываемая история Соединенных Штатов» и наверно был необычайно горд такой режиссерской находке. По результатам тех слушаний, однако, HUAC и суд признал Лоусона виновным в неуважении к Конгрессу [in contempt]. Ему впаяли 12 месяцев тюрьмы, штраф в 1000 долларов и запрет на написание сценариев для фильмов.

Самое интересное в этой истории заключается в том, что Лоусон сам навязался на слушания. Его туда силком не тянули. Его адвокаты сами вышли на контакт с HUAC и упросили комитет выслушать сценариста. Томас так и говорит: «Вы связались с нами через своих адвокатов и попросили дать вам возможность выступить. Мы хотим выслушать вас. Если вы не хотите, чтобы ваш голос был услышан, то тогда мы готовы отпустить вас и вычеркнуть из протокола все записи с вашими ответами».

Со второй половины 40-х, когда стало очевидным к чему идут дела - образовалась практически очередь индусов на отсидку в британской тюрьме. Совершить некоторое правонарушение - строго отмеренное, получить и отсидеть свои 6 месяцев, и voila - вот он вожделенный статус freedom fighter'а!

Практично. Почти как в одном раннесоветском юмористическом рассказе, где чиновники, боящиеся проверок на работу, прятались на время в психушке, чтобы только пересидеть аудит.

Лоусона вызвали по повестке. Он принес с собой длинное заявление, но Томас не позволил его зачитать. В незачитанном заявлении в частности говорилось:

"I am not only one of nineteen men who have been subpoenaed. I am forced to appear here as a representative of one hundred and thirty million Americans because the illegal conduct of this Committee has linked me with every citizen. If I can be destroyed no American is safe. You can subpoena a farmer in a field, a lumberjack in the woods, a worker at a machine, a doctor in his office — you can deprive them of a livelihood, deprive them of their honor as Americans. Let no one think that this is an idle or thoughtless statement. This is the course that the Un-American Activities Committee has charted. Millions of Americans who may as yet be unconscious of what may be in store for them will find that the warning I speak today is literally fulfilled. No American will be safe if the Committee is not stopped in its illegal enterprise. I am like most Americans in resenting interference with my conscience and belief. I am like most Americans in insisting on my right to serve my country in the way that seems to me most helpful and effective. I am like most Americans in feeling that loyalty to the United States and pride in its traditions is the guiding principle of my life. I am like most Americans in believing that divided loyalty — which is another word for treason — is the most despicable crime of which any man or woman can be accused. It is my profound conviction that it is precisely because I hold these beliefs that I have been hailed before this illegal court. These are the beliefs that the so-called Un-American Activities Committee is seeking to root out in order to subvert orderly government and establish an autocratic dictatorship. I am not suggesting that J. Parnell Thomas aspires to be the man on horseback. He is a petty politician, serving more powerful forces. Those forces are trying to introduce fascism in this country. They know that the only way to trick the American people into abandoning their rights and liberties is to manufacture an imaginary danger, to frighten the people into accepting repressive laws which are supposedly for their protection."

On September 21, 1947 the Committee began its attack by subpoenaing 41 individuals of "varying political colorations" to testify. The subpoenaes took some by surprise, though not those who had helped draw up the list. But at least nineteen of those subpoenaed, long term left-wing and progressive activists and members of the C.P.U.S.A., guilds, or other Popular Front organizations, had seen signs of trouble brewing for some time. These nineteen men made it clear from the start they would not cooperate with H.U.A.C., thereby earning the name "the Unfriendly Nineteen." The hearings began on October 13, 1947, with the friendly witnesses. During these first five days such individuals as producers Jack L. Warner and Louis B. Mayer, and novelist Ayn Rand testified against the evils of communism and those individuals in Hollywood trying to insert subversive communist ideas into motion pictures. By October 17, twenty two friendly witnesses had denounced over one hundred men and women. On October 20, Chairman Thomas called John Howard Lawson, a prominent screenwriter, founder and president of the Screen Writers Guild, and head of the Hollywood branch of the Communist Party, to the stand.

Mr. Stripling: I repeat the question, Mr. Lawson: Have you ever held any position in the Screen Writers Guild?
Mr. Lawson: I stated that it is outside the purview of the rights of this Committee to inquire into any form of association —
The Chairman: The Chair will determine what is in the purview of this Committee.
Mr. Lawson: My rights as an American citizen are no less than the responsibilities of this Committee of Congress.
The Chairman: Now, you are just making a big scene for yourself and getting all "net up." {Laughter.) Be responsive to the questioning, just the same as all the witnesses have. You are no different from the rest. Go ahead, Mr. Stripling.
Mr. Lawson: I am being treated differently from the rest.
The Chairman: You are not being treated differently.
Mr. Lawson: Other witnesses have made statements, which included quotations from books, references to material which had no connection whatsoever with the interest of this Committee.
The Chairman: We will determine whether it has connection. Now, you go ahead —
Mr. Lawson: It is absolutely beyond the power of this Committee to inquire into my association in any organization.
The Chairman: Mr. Lawson, you will have to stop or you will leave the witness stand. And you will leave the witness stand because you are in contempt. That is why you will leave the witness stand. And if you are just trying to force me to put you in contempt, you won't have to try much harder. You know what has happened to a lot of people that have been in contempt of this Committee this year, don't you?
Mr. Lawson: I am glad you have made it perfectly clear that you are going to threaten and intimidate the witnesses, Mr. Chairman.

Mr. Lawson: I am an American and I am not at all easy to intimidate, and don't think I am.

Mr. Stripling: Mr. Lawson, I repeat the question. Have you ever held any position in the Screen Writers Guild?
Mr. Lawson: I have stated that the question is illegal. But it is a matter of public record that I have held many offices in the Screen Writers Guild. I was its first president in 1933, and I have held office on the board of directors of the Screen Writers Guild at other times.

В тексте один раз упоминается то, что для Лоусона Гильдия адвокатов приготовила рекомендательное письмо «друга суда» - Amicus Curiae brief. В другом месте написано, что они заработали себе кличку «недружественные» после начала слушаний. Может быть, именно это письмо стало причиной того, что Томас сказал, что адвокаты и Лоусон сами предложили свои услуги Комитету?

Иначе непонятно высказывание Томаса. Он отправляет повестку Лоусону, а затем утверждает, что «You asked to be heard».

Лоусон очевидно рассчитывал, что ему дадут прочитать его заявление или хотя бы включат заявление в протокол, как это обычно принято на слушаниях в Конгрессе. Но Томас это дело пресек и воспользовался создавшимся замешательством.

Позже Пол Робсон приходил в HUAC, надеясь, что это поможет ему получить паспорт и выехать из страны, но тоже нарвался на агрессивные вопросы.
